This policy is for residents of Washington, Nevada and Connecticut. It also covers anyone whose health data is processed in Washington. It gives the details those states' consumer health data laws require. Fittcoaching LLC publishes MoonCycle and is responsible for this data. Our full Privacy Policy is at https://mooncycle.kamalov.systems/privacy.

1. Consumer health data we collect, and why

MoonCycle collects health data inside the app on your phone. Unless you turn on a feature that sends it out, it stays there and we never receive it.

Category Examples Why we collect it and how we use it
Menstrual and reproductive data Period days and flow, bleeding between periods, cervical mucus, basal body temperature, sexual activity, pill taken or missed, your mode (cycle, trying to conceive, pregnancy, perimenopause) To show your cycle, predict your next period and fertile window, and build your reports
Symptoms and wellbeing Symptoms, mood, energy, stress, and weight if you turn weight on To show patterns in your cycle
About you Conditions you mark, your birth control method, your goals, children and your last birth, breastfeeding, height, stress, training, night shifts, time-zone travel, your age range, the medicines you list To take into account in your estimates, to tailor what the app tells you, and (medicines and height) to fill the doctor PDF you create
Notes and attachments Text notes, voice notes (the recordings) and their transcripts, lab reports or photos you attach To keep your own records. While "Read my notes" is on, Ask MoonCycle reads your notes, and your older notes as monthly summaries. We do not create a voiceprint or any other identifier from your voice.
Lab results The results you save on a note: the test, the value and unit, the lab's reference range and flag, and the date. You type them, or OpenAI copies them from a lab report you send and you check them. To keep your own records, to show them on the note, to print them in the doctor PDF you create, and for Ask MoonCycle to read while "Read my notes" is on. MoonCycle does not say what a result means.
Ask MoonCycle Your questions and the chat, and the answers you report To answer your questions, and to check answers you report
Inferences Predictions, cycle statistics, observations "worth raising with a clinician", the AI text written for you, and the summaries of your older notes that Ask MoonCycle reads To give you estimates, patterns and written explanations, and to let Ask MoonCycle take your older notes into account. These are not diagnoses.
Data linked to a request for help Your age range; a code for your copy of the app, from which our relay makes a different code every month; and, on our relay, counts of requests per network address To answer your request and to stop abuse of the AI service

We do not collect precise location. We do not use geofences.

2. Where this data comes from

3. Consumer health data we share

We send consumer health data off your phone only after you give separate consent for that.

What is sent To whom When
Daily note: today's cycle phase (and, while your readings are in your cycle notes, the moon phase and your sun sign) OpenAI OpCo, LLC, through our relay Only while the AI switch is on
Report analysis: cycle and period length statistics, a temperature summary, the names of symptoms that show a pattern, the app's observations, pill taken or missed counts, today's cycle day and phase OpenAI OpCo, LLC, through our relay Only while the AI switch is on
Ask MoonCycle: your question and the last messages of the chat, today's date, your age range, a monthly code for your copy of the app, and what you switch on: your dated log (including stress), your notes (with the lab results saved on them, and the summaries of your older notes), what you shared in About you (including the weights you logged in the last year), your reading labels OpenAI OpCo, LLC, through our relay Only after you sign its authorization, and only the parts you switch on
Summaries of older notes: the notes of each older month, with their dates and the lab results saved on them, sent once to be summed up and again when you change or delete one of them OpenAI OpCo, LLC, through our relay, which keeps nothing Only after you sign the Ask MoonCycle authorization, while "Read my notes" is on, with MoonCycle Plus and the AI switch on. Turning "Read my notes" off stops it and deletes the summaries.
AI transcription: the recording of each voice note you have transcribed, which can contain anything you said OpenAI OpCo, LLC, through our relay, which keeps nothing Only while AI transcription is on: MoonCycle Plus, the AI switch on, and your separate consent to AI transcription
Copying lab results: pictures of the pages of each lab report you send, after your phone has covered your name, birth date and ID numbers where it can find them and you have covered anything else. A page can show anything you leave uncovered. OpenAI OpCo, LLC, through our relay, which keeps nothing Only with your consent: MoonCycle Plus, the AI switch on, and the lab reports line of its authorization signed, and then only each report you choose to send. You can withdraw by turning the AI switch off.
A question and answer you report Fittcoaching LLC and Kamalov Systems, on our relay, for 90 days Only when you tap "Report this answer"
The parts of your cycle you choose, encrypted Your partner, through our share relay, which cannot read it Only when you create a sharing link
Days you logged (period and flow, bleeding between periods, cervical mucus, temperature, sexual activity) Health Connect on your phone, and the apps you allow to read it there Only when you connect Health Connect and allow writing

Never sent, except where you say or type it yourself in a voice note you send for AI transcription, a question to Ask MoonCycle or a note it reads, or where it is printed on a lab report you send and left uncovered: your name, your birth date, your mode, your height, the medicines you list, anything from Health Connect, and, if you marked an eating disorder, that mark and your weight.

We do not sell consumer health data: we give it to no one in exchange for money or any other valuable consideration. We pay OpenAI to write the AI text. OpenAI may use what it receives only to provide its service to us, to follow the law, to enforce its usage policies and to prevent abuse. It does not train its models on it. It keeps API requests for up to 30 days, or longer if the law requires it or to protect people from harm, and its staff may review requests its systems flag.

4. Third parties and affiliates who receive it

Third parties:

Processors who handle data for us under a written contract:

Affiliates: we have none who receive consumer health data.

For Nevada residents: Nevada law treats sending data to these processors as sharing, so each one is named here, and each send needs your consent first.

5. Your rights and how to use them

You have the right to:

How to make a request. Email bertbertov@gmail.com, or write to Fittcoaching LLC, 7654 19th St W, Tacoma, WA 98466-3615, United States. We may need to confirm the request came from you. We answer within 45 days. If we need more time, we tell you why and take at most 45 more days. If you live in Nevada, we delete within 30 days after confirming the request is yours. Requests are free up to twice a year.

Appeal. If we refuse your request, reply with the word "Appeal" within 45 days. We decide within 45 days and explain why. If we refuse the appeal, you can complain to the attorney general of your state. In Washington, that is the Attorney General's Office at atg.wa.gov.

6. Tracking

No third party tracks you across websites or apps through MoonCycle. The app has no advertising, analytics or tracking tools.

7. Changes and contact

If we change how we collect or share consumer health data, we update this policy first and tell you in the app. A new purpose or a new kind of sharing needs your consent before it starts.
